HOW DO I CHANGE MY SYNDIC?
A syndic's mandate is for a maximum of 3 years. He can of course be appointed several times successively by the general assembly which will renew the syndic in his functions but always within the limit of 3 years per mandate.
A NECESSARY AND COMPULSORY COMPETITION
Changing the syndic requires the competition of several contracts in order to compare the services.
The law has introduced the obligation to proceed to this competition. If the co-ownership is satisfied with it's syndic, the general assembly can nevertheless exempt the Syndical Council from carrying out this competition by a majority of the votes of all the co-owners.
CHANGE OF SYNDIC AT THE END OF THE MANDATE
A new syndic can be appointed at the end of each contract. To do so, the subject must be included in the agenda of the general meeting.
This request for inclusion on the agenda must be sent to the managing agent before the convocation of the general meeting is sent by registered mail with acknowledgement of receipt on which the draft resolution must be written.
The decision will be taken by the majority of article 664-35 of the law (the majority of the votes of all the co-owners).
The revocation of the managing agent during his mandate
Exceptionally, the general assembly has the possibility to proceed to the dismissal of the managing agent during his mandate. This dismissal must be based on a legitimate reason. It is then necessary to prove a fault of the syndic.
The dismissal of the syndic will put an immediate end to his functions. It will thus be important to have looked for another syndic beforehand and to have asked the syndic in place to put his election on the agenda of the general assembly.
